1. Agreement to Terms

By accessing or using the Growth Signals platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Use of Service

2.1 Eligibility

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or internal business purposes. This license does not include the right to:

• Modify, copy, or create derivative works of the Service
• Reverse engineer or attempt to extract the source code of the Service
• Resell, sublicense, or redistribute the Service or its content
• Use any data mining, robots, or similar data gathering methods

3.3 Report Usage

Our benchmark reports and analytics are provided for informational purposes only. You may reference our data with proper attribution to Growth Signals. Wholesale reproduction or redistribution of our reports is prohibited without prior written consent.

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

We collect and analyze publicly available data about DTC brands for our benchmark reports. If you represent a brand featured in our reports and have concerns about the data we present, please contact us at hello@growthsociety.co.uk.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. The data and analytics we provide are based on publicly available information and our proprietary methodologies; we do not guarantee the accuracy, completeness, or reliability of any information or analysis.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTH SIGNALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim, or one hundred pounds (£100), whichever is greater.

7. Indemnification

You agree to indemnify and hold harmless Growth Signals and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
